Gascoyne spent 2008 at odds with former team principal Colin Kolles over the question of how money was being spent and whether or not team boss Vijay Mallya had a realistic view of how the team was developing. After he was dumped by the team he threatened legal action, claiming $2.5m in salary and a percentage of money he would have earned in 2010 and 2011 if he had taken up his option to stay with the team.
